1. The Personal Data Controller is ML System+ sp. z o.o. with its registered office in Zaczernie, 190 G, 36-062 Zaczernie, entered into the Register of Entrepreneurs of the National Court Register by the District Court in Rzeszów, 12th Commercial Division of the National Court Register under KRS number 0000471680, holding NIP (Tax ID): 5170363419, REGON: 181004641, with a share capital of PLN 100,000.

3. The Personal Data Controller processes the personal data of Customers or persons interested in the offer for the following purposes:
- 3.1. Processing of personal data in order to perform a contract. The data controller processes the personal data of Customers or persons interested in the offer based on Article 6(1)(b) of the GDPR, in order to conclude or perform a contract for which data processing is necessary. The data controller processes personal data such as: First name, last name, e-mail, mobile phone number, Tax ID (NIP), and bank account number.
- 3.2. Processing of personal data based on legal obligations. The data controller processes Customers’ personal data based on Article 6(1)(c) of the GDPR, among others, to issue and store invoices and accounting documents.
- 3.3. Processing of personal data to pursue our legitimate interests. The data controller processes the personal data of Customers or persons interested in the commercial offer based on Article 6(1)(f) of the GDPR for the following purposes:
- Pursuing claims related to the concluded contract, where the legitimate interest of the data controller is debt collection and conducting court proceedings, or potentially establishing, pursuing, or defending against claims.
- Archival purposes and keeping statistics, where the legitimate interest of the data controller is having statistical information about the actions taken to improve business operations.
- Collecting statistical data and analyzing website traffic. The website https://mlsystemplus.pl/ collects information contained in system logs (e.g., IP address). These are used for technical purposes related to website administration. IP addresses are used to collect general statistical information about website visitors.
- Maintaining security and preventing violations by implementing video surveillance at the data controller’s premises.
4. Possibility to withdraw consent. If personal data is processed based on granted consent, the data subjects have the right to withdraw their consent to data processing at any time. The withdrawal of consent does not affect the lawfulness of processing based on consent before its withdrawal.
5. Voluntary provision of personal data. Providing data is voluntary; however, failure to provide it will prevent the conclusion and performance of the contract. If the contract has not yet been concluded, failure to provide data will prevent actions taken to conclude it. If data is processed based on consent – providing it is voluntary.
6. Recipients of personal data. Personal data will be processed independently by the data controller or through entities authorized by the data controller (employees and associates), as well as data processors based on contracts concluded with the data controller, e.g., IT service providers, accounting services, entities providing legal assistance, and security service providers – to the extent necessary to achieve the purposes for which the personal data is processed. Such entities process data based on a data processing agreement and only within the limits specified in the agreement, according to the data controller’s instructions.
7. Retention period for personal data. The personal data of data subjects is kept for no longer than is necessary.
- 7.1. If the basis for personal data processing is the performance of a contract, the personal data will be kept until the contract is performed. If the contract has been performed, the personal data will be processed for a period corresponding to the statute of limitations for claims.
- 7.2. If the basis for processing is consent, the personal data will be processed as long as the consent is not revoked (no longer than 5 years), and after the revocation of consent, for a period corresponding to the statute of limitations for claims.
- 7.3. In the case of data processing in connection with legal obligations, the data will be processed to the extent and for the time required by law.
8. Rights of data subjects. Data subjects have the following rights related to personal data processing: the right to access their personal data, the right to request rectification of personal data, the right to request the erasure of personal data, the right to request the restriction of processing, the right to data portability, and the right to object.
9. Objection to data processing. If a person objects to the processing of their personal data, and the data is processed by the controller based on a legitimate interest or a task carried out in the public interest, the data controller will respect the objection unless there are compelling legitimate grounds for the processing which override the interests, rights, and freedoms of the person objecting, or grounds for the establishment, exercise, or defense of legal claims.
10. Objection to direct marketing. If a person objects to the processing of their data by the data controller for direct marketing purposes, the data controller will cease such processing.
11. Right to lodge a complaint with an authority. Data subjects have the right to lodge a complaint with the supervisory authority dealing with personal data protection, i.e., the President of the Personal Data Protection Office (Prezes Urzędu Ochrony Danych Osobowych).
12. No automated decision-making. Based on the processed personal data, the data controller will not make automated decisions regarding data subjects, including decisions resulting from profiling.
13. Data transfer to Third Countries. The data controller does not intend to transfer the personal data of Customers / persons interested in the offer to third countries outside the European Economic Area or to international organizations.
14. Cookies Policy Information about the use of cookies:
- Cookies – IT data, in particular small text files, saved and stored on devices through which the User accesses websites.
- Session cookies – stored on the User’s Device and remain there until the browser session ends. The saved information is then permanently deleted from the Device’s memory. The session cookies mechanism does not allow the collection of any personal data or confidential information from the User’s Device.
- Persistent cookies – stored on the User’s Device and remain there until deleted. Ending a browser session or turning off the Device does not remove them from the User’s Device. The persistent cookies mechanism does not allow the collection of any personal data or confidential information from the User’s Device.
Purpose of using Cookies:
- Gaining access to basic website functions,
- Improving the services we provide by using data for statistical and analytical purposes,
- Ensuring security while using our website,
- Learning the preferences of users visiting our website.
The User can independently and at any time change the settings regarding Cookies, specifying the conditions for their storage and access to the User’s Device.
